After alleged incidents captured on video
A Mar- ble City man who is set to appear for a felony disp o s i t i o n docket in Sequoyah County District Court on felony charges of alleged sexual battery, first degree rape and sodomy victim mentally incapacitated, is now also scheduled to appear before Special Judge Matt Orendorff on September 28.
Darrell W. Rogers, 68, was formally charged on July 26 and a warrant was issued for his arrest, according to court records.
Special Judge Orendorff set Rogers’ bond at $20,000 and ordered him to have no contact with the alleged victim as a condition of his bond, according to court documents.
Following a July 26 arraignment, he is set to appear before Associate District Judge Kyle Waters for an August 30 felony disposition docket. He pled not guilty and was ordered to be held without bond at that time, according to court documents.
However, court records show a motion to set bond for Rogers was granted on August 16 in the amount of $45,000.
Sallisaw Police Detective Jeffrey Craghead reported receiving a flash drive containing a large amount of video footage from a reporting party on July 20. The reporting party claimed the footage contained audio and video clips of Rogers allegedly sexually abusing an elderly victim.
The reporting party said the alleged victim had been diagnosed with late onset Alzheimer’s and dementia, and could not communicate effectively. It was also noted that the alleged victim was very childlike in behavior.
The alleged incidents provided by the reporting party occurred between June 2 and July 17, 2023, at a residence on Bluff Drive.
Craghead said when he opened the flash drive, the files didn’t have names that corresponded with any known date or time. The reporting party claimed when they saved the files to their phone, it changed the names of them. The detective said due to the large number of files on the flash drive it would take some time to locate all the footage.
Craghead then provided details from two videos that reportedly showed Rogers touching the alleged victim’s buttocks and breasts in an inappropriate manner.
If found guilty of felony sexual battery, District Attorney Jack Thorp said the crime is punishable by imprisonment for up to 10 years.
